Bill Summary
This bill requires the use of carbon monoxide detectors in child care centers and public and private elementary and secondary schools that are served by a fuel- burning appliance. Carbon monoxide detectors required in a building designed after the bill’s effective date must be permanently powered by the building’s electrical system. In addition, the bill requires that the carbon monoxide detectors installed bear a listing mark from Underwriters Laboratories, Inc., or a similar independent product safety certification organization. The bill also requires owners of child care centers and public and private elementary and secondary schools to reasonably maintain all carbon monoxide detectors as specified in the detectors’ instructions. Under current law, generally, carbon monoxide detectors are required in dwellings with an attached garage, a fireplace, or a fuel-burning appliance. Carbon LRB-5773/1 KP&CMH:ajk 2025 - 2026 Legislature SENATE BILL 1065 monoxide detectors are also required in public buildings that are used for sleeping or lodging purposes and that contain a fuel-burning appliance, a fuel-burning forced-air furnace, or an attached garage. Under current law, the Department of Justice awards grants to schools for improving school safety and for submitting interactive critical mapping data for school buildings and facilities to law enforcement agencies and DOJ. The bill requires DOJ to award grants to schools for expenditures related to the requirement created by the bill to have carbon monoxide detectors in their buildings. For further information see the state and local fiscal estimate, which will be printed as an appendix to this bill.
AI Summary
This bill mandates the installation and maintenance of carbon monoxide detectors in child care centers and public and private elementary and secondary schools that use fuel-burning appliances, such as furnaces or stoves. For new buildings or those designed after the bill's effective date, these detectors must be permanently powered by the building's electrical system, while older buildings can use battery-powered detectors or those integrated with the building's electrical and fire alarm systems. All detectors must be certified by a recognized safety organization like Underwriters Laboratories, Inc. (UL). The bill also requires owners to reasonably maintain these detectors according to manufacturer instructions and amends existing law to allow for inspections of these facilities for compliance. Furthermore, it establishes a grant program administered by the Department of Justice (DOJ) to help schools cover the costs of purchasing and installing these detectors, allocating $75,000 for this purpose in fiscal year 2025-26, and requires the DOJ to report on the grant awards. This expands upon current law, which generally requires carbon monoxide detectors in dwellings with specific fuel-burning features and in public buildings used for sleeping.
