This bill, effective August 1, 2026, prohibits local elected officials and employees of cities, counties, and towns (referred to as "local government") from entering into nondisclosure agreements, also known as confidentiality agreements, that prevent the public from knowing about potential data center developments within their jurisdiction. A data center is a facility that houses computer systems and associated components, such as telecommunications and storage systems. If a local government enters into an agreement that violates this prohibition, the entire agreement is considered void and unenforceable, and the local government must publicly disclose the contract.
