This bill, effective August 1, 2026, prohibits local elected officials in Minnesota from signing nondisclosure agreements, also known as confidentiality agreements, that would prevent them from publicly sharing information about potential data center developments within their jurisdiction. A "data center" is defined as a facility that houses computer systems and associated components, such as telecommunications and storage systems. "Local elected official" is broadly defined to include members of city councils, mayors, county commissioners, watershed district managers, town supervisors, and any other elected official established by a home rule charter. Any such agreement that violates this prohibition will be considered void and unenforceable, meaning it will have no legal effect, though other parts of the contract will remain valid. If a local elected official does enter into a prohibited agreement, they are required to publicly disclose that contract or agreement.
