This bill, known as the "no gambling ads for kids act," prohibits operators of "covered platforms" (public or semi-public websites, online services, or applications that allow user profiles) and social media platforms from showing advertisements for various forms of gambling to minors, defined as individuals under 18 in New York. These gambling forms include online gaming-related gambling (like in-game purchases for random rewards or trading virtual items for real money), predictive market wagering (betting on future events), online sweepstakes gaming (games with dual-currency systems that simulate gambling), sports-related gambling (including fantasy leagues and betting on sporting events), and traditional online gambling (like online casinos and lotteries). Operators must reasonably determine a user is not a minor before displaying such ads, and any information collected for age verification cannot be used for other purposes and must be deleted afterward. Violations are considered false advertising and can be enforced by the Attorney General or the New York State Gaming Commission, which will also maintain websites for public complaints and provide industry guidance.
