This bill, known as the "no gambling ads for kids act," prohibits operators of "covered platforms" (websites, online services, or applications that allow users to create public profiles, including social gaming platforms) and social media platforms from showing advertisements for services that permit various forms of gambling to minors, defined as individuals under 18 years old in New York. These gambling services include online gaming-related gambling (like loot boxes or in-game items purchased with real money), predictive market wagering (betting on future events), online sweepstakes gaming (games accessible online that simulate gambling with a dual-currency system), sports-related gambling (including fantasy leagues and sports betting), and traditional online gambling (like online slots or poker). Operators must reasonably determine a user is not a minor before displaying such ads, and any information collected for age verification can only be used for that purpose and must be deleted afterward. Violations are considered false advertising and can be enforced by the Attorney General or the New York State Gaming Commission, with the Attorney General maintaining a website for public complaints and issuing regulations to implement the act.
