Bill Summary

AN ACT to amend the general business law, in relation to enacting the "protecting our kids from gamification of gambling act"

AI Summary

This bill, known as the "protecting our kids from gamification of gambling act," makes it unlawful for operators of social gaming platforms to provide services to users under 18 years old that involve online gaming-related gambling. This includes activities like exchanging real money for random, chance-based rewards such as "loot boxes" (add-on transactions with randomized content) or "pay-to-win microtransactions" (purchases that give a competitive advantage or ease progression), as well as trading or betting with in-game items acquired with real money, like "skins" (virtual cosmetic items often bought through loot boxes and tradable for real-world value). Operators must reasonably determine a user's age before allowing them to engage in these activities, and any collected age information can only be used for age verification and must be deleted afterward, unless required by law. Violations are considered deceptive practices, enforceable by the Attorney General, who will also maintain a website for public complaints and issue necessary regulations.
