Bill Summary

AN ACT to amend the education law, in relation to the submission of requests to the committee on special education for the educational services mandated by an individualized education services program

AI Summary

This bill requires school districts to annually provide written notice to parents or guardians of students with disabilities attending nonpublic schools within their district about how to request special education services, starting with the 2026-2027 school year. This notice must be provided in common non-English languages (except in New York City, which has its own translation policies), at least 28 days before deadlines for requests, clearly state all deadlines and procedures, and include contact information for assistance. Additionally, for the 2024-2025 school year only, a special provision applies to New York City school districts (cities with one million or more inhabitants) where parents of students who missed some or all of their individualized education services program (an educational plan for students with disabilities) due to the district not providing them, can request an expedited review by the committee on special education (a group that oversees special education services) by October 2026. This review will consider how the missed services impacted the student's educational progress and will incorporate any findings into future service recommendations.
