This bill establishes a new law in Florida that prohibits any person under the age of 18 from operating a motor vehicle while using a wireless communications device or telephone, even if it's a hands-free device. A "wireless communications device" is broadly defined to include any device that can send or receive text messages, access data, connect to the internet, or use a communications service for text. However, this restriction does not apply if the vehicle is legally parked and not in operation, or if the device is being used for emergency purposes, such as calling law enforcement, a healthcare provider, or other emergency services. Violating this law will be considered a noncriminal traffic infraction, which counts as a moving violation.
