This bill, titled "Relative to the dismissal of teachers," proposes to add a new section to Chapter 71 of the General Laws that would provide immunity from civil liability to employers, defined as any Massachusetts school district, charter school, or private school, when they provide information about a current or former employee's job performance and professional conduct in response to a request for a reference from a prospective employer or from the Commissioner of Education regarding an educator's license. Job performance is broadly defined to include aspects like abilities, attendance, attitude, and disciplinary actions. This protection, however, would not apply if the employer knowingly or recklessly releases false information.
