This bill proposes an amendment to existing law regarding property storage after an eviction, specifically within the context of summary process, which is a legal procedure for landlords to regain possession of their property. The key provision exempts certain landlords from paying the costs associated with removing a tenant's personal property from the premises after an eviction. This exemption applies to landlords whose household income is 125% or less of the poverty threshold set by the Community Services Administration, or who receive specific forms of public assistance, such as transitional aid to families with dependent children, emergency aid to the elderly, disabled and children, veterans' benefits, Title XVI of the Social Security Act, or the Medicaid program. To qualify for this exemption, a landlord must provide proof of their income status or public assistance receipt to the officer serving the eviction notice, either through an affidavit of indigency or a written declaration under penalty of perjury. The officer will then submit this documentation to the court, and any removal costs not paid by an exempt landlord will be considered a warehouser storage fee and can be included in the warehouser's lien.
