This bill amends existing labor laws in Massachusetts concerning the pooling of tips, which are voluntary payments given to service employees. Specifically, it clarifies that a supervisor in a "quick service restaurant" (defined as an establishment where food is primarily served over a counter or drive-up window with little to no table service, and employees earn at least the minimum wage for non-service staff) who also serves customers and doesn't hold a high-level executive position, will be considered a "wait staff employee" for the purpose of tip pooling. This means such supervisors can participate in tip sharing with other wait staff. The bill also explicitly states that employers are not prohibited from having policies that ban the acceptance of gratuities altogether.
