This bill amends existing Massachusetts law, specifically Chapter 152 of the General Laws concerning workers' compensation, to make coverage elective for officers of non-profit entities or corporations, as defined by the Internal Revenue Code, who are not receiving any compensation. This means that such officers can choose whether or not to be covered by workers' compensation. To opt out, the corporate officer must provide a written waiver of their rights under this chapter to the director of industrial accidents, who will then create regulations to implement this provision, and non-profit corporations that violate these new rules will face penalties outlined in Section 25C.
