This bill proposes to amend existing law regarding collective bargaining for public employees by adding a new provision that clarifies the application of "fair share" payments. Specifically, if a collective bargaining agreement does not include a negotiated agency service fee, then the "fair share" provision will apply to any employee who chooses not to join the union. This means such employees would be required to pay the union a percentage of their dues, equivalent to what is paid for negotiations on wages, benefits, working conditions, and grievance and arbitration rights. Failure to pay this fair share would result in the employee being excluded from most benefits of the collective bargaining agreement, with the exception of negotiated Cost of Living Adjustment (COLA) increases.
