This bill amends existing laws related to weights and measures by introducing new definitions for "precious metal" (gold, silver, or platinum) and "secondhand dealer" (businesses that buy, sell, or trade used goods, excluding those who recycle metals). It mandates that weighing and measuring devices used by secondhand dealers and precious metal dealers must be officially sealed by a local Sealer of Weights and Measures at least every two years, or within 72 hours before any transactions if the business lacks a physical retail location. Furthermore, these devices must be positioned for clear observation by both buyers and sellers, and secondhand dealers must conspicuously post their prices for purchasing precious metals, including specific prices per troy ounce for different karats of gold, silver, and platinum, with a conversion chart to metric units if applicable. Failure to comply with these provisions is considered an unfair or deceptive business practice under chapter 93A, which is a law governing consumer protection.
