The key change is the prohibition of using a mobile telephone or mobile electronic device for voice communications unless it is operated in a hands-free manner, meaning the driver is not holding the device. This restriction applies to all operators of motor vehicles. However, there are exceptions: drivers can use their phones to activate, deactivate, or initiate a feature or function, and an affirmative defense for alleged violations can be made if the use of the mobile telephone was for an emergency. An emergency is defined as needing to communicate to report a disabled vehicle or vessel, a need for medical attention or assistance, a necessity for police, fire, or other emergency services for personal safety or public safety, or the presence of a disabled vehicle or an accident on a roadway.
