This bill establishes regulations for the use of Automatic License Plate Reader (ALPR) systems, which are automated systems that capture images of license plates and convert them into computer-readable data. The bill defines "ALPR data" as any information captured by these systems, including license plate numbers, dates, and locations. It permits law enforcement agencies to use ALPR systems for legitimate law enforcement purposes, such as investigating crimes or traffic violations, and allows the Department of Transportation to use them for collecting tolls or parking fees. Law enforcement agencies must permanently erase ALPR data within 48 hours of capture, unless it is transferred to the Executive Office of Public Safety and Security (Executive Office), which can retain it for 120 days, or longer if required for a search warrant, production order, or preservation request. The bill prohibits governmental entities from accessing ALPR data from non-governmental entities that retain it for longer periods than the Executive Office. It also restricts the use of ALPR data for purposes like determining credit ratings, insurance rates, or employment decisions, and outlines conditions for its admissibility in legal proceedings. The bill allows for civil action and damages for violations and requires the Executive Office to report annually on ALPR system usage.
