This bill authorizes the Hampshire Council of Governments, a regional governmental body, to secure certain financial obligations related to its activities as an "supplier" as defined by state law, which in this context refers to entities involved in providing electricity. Specifically, the bill allows the council, with the approval of a weighted majority of its councilors, to enter into contracts, incur debt, borrow money, issue notes and bonds, and make guarantees, including agreements for purchasing, selling, or hedging electricity. To secure these obligations, the council can grant liens or security interests on its personal property and assets derived from its electricity supply activities, such as franchises, income, revenues, and contracts, and can keep these funds in separate collateral accounts. Importantly, the council will be solely responsible for repaying any debt incurred, and these obligations will not be considered a debt of the Commonwealth of Massachusetts or backed by its full faith and credit. However, the bill explicitly prohibits the council from granting liens on its real property for these electricity-related activities or on any emergency communications equipment or assets of the Hampshire County Group Insurance Trust.
