This bill proposes to amend existing land use regulations by adding a new section that prohibits cities and towns in the Commonwealth from enacting or enforcing unfair and excessive land use regulations on individual landowners without providing compensation or other forms of relief. Land use regulations are broadly defined to include zoning changes that restrict property use, decisions by local boards that limit potential uses, or any other local action that restricts private property use or reduces its fair market value. Under this bill, landowners negatively impacted by such regulations would be entitled to compensation for the loss of use or potential uses of their property, as well as monetary compensation for any reduction in its fair market value.
