This bill authorizes the commissioner of capital asset management and maintenance, in consultation with the department of developmental services, to grant specific parcels of land in Springfield to The Association for Community Living, Inc. for the purpose of building and operating a residential facility for individuals with developmental disabilities. The land, described by a specific plan and recorded with Hampden county, is part of property already owned by the commonwealth. The conveyance will be for a nominal fee, but if the property is later sold by The Association for Community Living, Inc. for purposes other than those stated, 50 percent of the net proceeds must be paid back to the commonwealth, unless the sale is due to a mortgage foreclosure. The Association for Community Living, Inc. will also be responsible for all costs associated with this land transfer, including surveys, plans, and recording fees. This action is declared an emergency law to ensure its immediate effect.
