This bill authorizes the commissioner of the division of capital asset management and maintenance, in consultation with the department of developmental services, to grant specific parcels of land in Springfield to The Association for Community Living, Inc. This transfer is for the purpose of building, maintaining, and operating a residential facility for individuals with developmental disabilities, and it overrides any conflicting laws. The land being transferred is identified by a specific plan and is part of property already owned by the commonwealth. The conveyance will be for a nominal fee, meaning a very small or symbolic amount of money, and the commissioner will document the property's value for its highest potential use and for its intended use, noting any difference between the two in a public record. If The Association for Community Living, Inc. later sells the property and it's no longer used for its intended purpose, 50 percent of the net profits will go back to the commonwealth, unless the sale is due to a mortgage foreclosure. Furthermore, The Association for Community Living, Inc. will be responsible for all costs associated with this land transfer, including surveys, plans, and recording fees.
