This bill amends the Penal Law to modify the provisions related to insurance fraud in the fourth degree. The key changes are: (1) a person is guilty of insurance fraud in the fourth degree if they commit a fraudulent insurance act and wrongfully take, obtain, or withhold property worth more than $1,000; and (2) a person is also guilty if they falsely claim their principal residence or the principal location of their vehicle is in another state, when in fact it is in New York. The bill provides an exception for people who have a second residence or attend school in another state and truthfully disclose this to the insurance company. Insurance fraud in the fourth degree is a class E felony.
