This bill amends the Penal Law to modify the definition of insurance fraud in the fourth degree. Specifically, it adds that a person is guilty of insurance fraud in the fourth degree if they commit a fraudulent insurance act and conceal the fact that their principal residence or the principal garage location for their motor vehicle is in New York, when it is actually located in another state. This section does not apply if the person truthfully discloses to the insurance company that they have a secondary residence or attend an educational institution in the other state where they also drive and garage their vehicle. Insurance fraud in the fourth degree is a class E felony.
