This bill, the Synthetic Abuse and Labeling of Toxic Substances (SALTS) Act of 2018, amends the Controlled Substances Act to set forth factors that may be considered in determining whether a controlled substance analogue (a drug similar to an illegal drug) is intended for human consumption. Under current law, a controlled substance analogue intended for human consumption is treated as a Schedule I controlled substance, which has a high potential for abuse, no accepted medical use, and is subject to regulatory controls and penalties. The new factors that may be considered include the marketing, advertising, and labeling of the substance, the known efficacy or usefulness of the substance for the marketed purpose, the difference in price compared to the substance it is purported to be, the diversion of the substance from legitimate channels, and whether the defendant knew or should have known the substance was intended for immediate consumption. The bill also states that evidence that a substance was not marketed, advertised, or labeled for human consumption, by itself, shall not be sufficient to establish that the substance was not intended for human consumption.
