Bill Summary

This bill criminalizes the manufacture, sale, and possession of 3,4-Dichloro-N-[2-(dimethylamino)cyclohexyl]-N-methylbenzamide, also known as U-47700, as well as any of its isomers, esters, ethers, salts and salts of isomers, esters, and ethers. Also known by the street name "Pink," U-47700 is a synthetic opioid analgesic drug described as eight times stronger than heroin. Under the bill, it is a crime of the second degree to manufacture, distribute or dispense, or possess with the intent to manufacture or distribute or dispense, U-47700 in a quantity of one ounce or more. It is a crime of the third degree if the quantity involved is less than one ounce. The bill further provides that it is a crime of the fourth degree to obtain or possess U-47700 in a quantity of one ounce or more. It is a disorderly persons offense if the quantity obtained or possessed is less than one ounce. A crime of the second degree is punishable by a term of imprisonment of five to 10 years, a maximum fine of $150,000, or both. A crime of the third degree is punishable by a term of imprisonment of three to five years, a maximum fine of $15,000, or both. A crime of the fourth degree is punishable by a term of imprisonment of up to 18 months, a fine of up to $10,000, or both. A disorderly persons offense is punishable by a term of imprisonment of up to 6 months, a fine of up to $1,000, or both.
