Prohibiting municipalities from limiting persons' rights to possess certain weapons

This bill prohibits municipalities in West Virginia from limiting a person's right to purchase, possess, transfer, own, carry, transport, sell, or store any deadly weapon, firearm, or pepper spray, or any associated ammunition or ammunition components. However, municipalities can enact and enforce ordinances that prohibit or regulate the carrying or possession of such items in municipally owned or operated buildings and recreation facilities. The bill also provides an absolute defense against any alleged violation of such municipal ordinances if the person leaves the premises or temporarily relinquishes the item when informed that their possession is contrary to the ordinance, and they were otherwise lawfully in possession of the item.
