This bill amends the existing law in Massachusetts to allow supervisors at quick service restaurants who serve customers and do not qualify as executive-level employees to be considered wait staff employees for the purposes of tip pooling. It also defines "quick service restaurant" as an establishment where food or beverages are primarily served over a counter or drive-up window, with minimal direct table service, and where employees are paid at least the minimum hourly wage for non-service workers. Additionally, the bill states that nothing in the law prohibits an employer from establishing a policy prohibiting the acceptance of gratuities.
