This bill amends Massachusetts law to allow supervisors in quick service restaurants who serve patrons or customers to be considered as "wait staff employees" for the purposes of tip pooling, provided they do not qualify as employees in a bona fide executive capacity. It also defines "quick service restaurant" as an establishment selling food or beverages where products are primarily served over a counter or drive-up window, with minimal direct service to seated patrons, and where employees are paid at least the minimum required hourly wage for non-service employees. Additionally, the bill states that nothing in the law prohibits an employer from establishing a policy prohibiting the acceptance of gratuities.
