This bill aims to enhance, update, and protect the 2013 motor vehicle right to repair law and consumer rights. The key provisions include: 1. Defining "Mechanical Vehicle Data" as any telematics data in a vehicle related to its diagnosis, repair, or maintenance, and "Telematic System" as any system that collects and stores information generated by the vehicle's operation using wireless communications. 2. Requiring standardized and open access to vehicle on-board diagnostic systems for vehicle owners and independent repair facilities, without the need for manufacturer-specific authorization. 3. Mandating that starting in model year 2022, manufacturers utilizing telematics systems must equip their vehicles with an interoperable, standardized, and open access platform that allows vehicle owners and lessees, as well as independent repair facilities, to securely access all mechanical data, and send commands to in-vehicle components for maintenance, diagnostics, and repair purposes. 4. Directing the Attorney General to establish a consumer motor vehicle telematics system notice to inform consumers about the data collected and their rights to access and control the data, including the ability to provide or restrict the transmission of telematics data to the manufacturer. 5. Requiring vehicle dealers to provide the telematics system notice to consumers and obtain their signature when selling a vehicle with a telematics system. 6. Prohibiting manufacturers from selling new vehicles in the Commonwealth if they fail to comply with the requirements of the act, until the Attorney General is satisfied that the manufacturer has cured all problems and is in full compliance.
