This bill aims to enhance, update, and protect the 2013 motor vehicle right to repair law and consumer rights. The key provisions of the bill include: 1. Defining "Mechanical Vehicle Data" as telematics data related to the diagnosis, repair, or maintenance of a vehicle, and "Telematic System" as any system that collects and stores information generated by the operation of the vehicle using wireless communications. 2. Requiring standardized and open access to vehicle on-board diagnostic systems for vehicle owners and independent repair facilities, without the need for manufacturer authorization, unless the authorization system is standardized across all makes and models. 3. Mandating that starting in model year 2022, manufacturers using a telematic system must equip their vehicles with an interoperable, standardized, and open access platform that can securely communicate all telematic vehicle data to the vehicle owner or lessee, as well as to independent repair facilities and authorized dealers, for maintenance, diagnosis, and repair purposes. 4. Directing the Attorney General to establish a consumer notice on motor vehicle telematic systems, which must explain the collected data, consumer access, and the ability for independent repairers to access the data with consumer permission. 5. Requiring dealers to provide the consumer telematic system notice to be read and signed by the consumer when selling a vehicle with a telematic system. 6. Prohibiting manufacturers from selling new vehicles in the Commonwealth if they fail to comply with the requirements of the act, until the Attorney General is satisfied that the manufacturer has addressed the issues and is in full compliance.
