This bill aims to enhance, update, and protect the 2013 Motor Vehicle Right to Repair Law and Consumer Rights. It does this by: 1. Defining "Mechanical Vehicle Data" as any telematics data in a vehicle related to its diagnosis, repair, or maintenance, and "Telematic System" as any system in a vehicle that collects and stores information generated by the vehicle's operation using wireless communications. 2. Requiring manufacturers of vehicles sold in the Commonwealth that use a telematics system to equip such vehicles with an interoperable, standardized, and open access platform that can securely communicate all telematics vehicle data in a standardized format. This platform must be directly accessible by the vehicle owner or lessee, and upon their authorization, independent repair facilities and dealers can access the mechanical data for maintenance, diagnostics, and repair purposes. 3. Directing the Attorney General to establish a consumer motor vehicle telematics system notice that explains the system, the data collected, the consumer's ability to access the data, and the ability for independent repairers to access the data with the consumer's permission. 4. Requiring dealers to provide the consumer the telematics system notice when selling a vehicle with such a system and obtain the consumer's signature. 5. Prohibiting a manufacturer from selling new motor vehicles in the Commonwealth if they fail to comply with the requirements of this act, until the Attorney General is satisfied the manufacturer has cured the issues and is in full compliance.
