This bill aims to enhance, update, and protect the 2013 Motor Vehicle Right to Repair Law and consumer rights. Key provisions include: 1. Defining "Mechanical Vehicle Data" as telematics data in a vehicle related to its diagnosis, repair, or maintenance, and "Telematic System" as any system that collects and stores information generated by the vehicle's operation using wireless communications. 2. Requiring access to vehicle on-board diagnostic systems to be standardized and not require manufacturer authorization, unless the authorization system is standardized across all makes and models sold in the Commonwealth and administered by an entity unaffiliated with a manufacturer. 3. Mandating that starting in model year 2022, manufacturers utilizing a telematics system must equip vehicles with an interoperable, standardized, and open access platform that can securely communicate all telematics vehicle data to the vehicle owner or lessee, and upon their authorization, to independent repair facilities or licensed dealers. 4. Directing the Attorney General to establish a consumer notice about the vehicle's telematics system, including its capabilities and the consumer's right to access and control the data. 5. Requiring dealers to provide the consumer telematics notice to be read and signed when selling a vehicle with a telematics system. 6. Prohibiting manufacturers from selling new motor vehicles in the Commonwealth if they fail to comply with the requirements of this act, until the Attorney General is satisfied they have cured the problems and are in full compliance.
