This bill deletes a provision that previously required tenants to pay accrued rent into the court registry within 5 days of being served, or else waive their defenses other than payment. The bill removes this automatic waiver, allowing tenants to assert other defenses in an eviction case without having to first pay rent into the court registry. The bill also clarifies that public housing tenants or those receiving rent subsidies only need to deposit their portion of the full rent amount. The bill takes effect on July 1, 2020.
