This Study Bill establishes that the lawful manufacture, distribution, and sale of firearms and ammunition are not inherently dangerous activities, and that the unlawful use of these items, not their legal production or sale, is the cause of injuries. It explicitly prohibits lawsuits against firearm and ammunition manufacturers, distributors, importers, trade associations, sellers, or dealers for damages or injunctions related to the lawful design, manufacture, marketing, or sale of these products, or for damages resulting from the criminal misuse of firearms or ammunition by a third party. If a lawsuit is brought under these prohibited grounds, it will be dismissed, and the defendant will be awarded attorney fees and costs. However, the bill does allow for lawsuits in specific circumstances, such as for breach of contract or warranty, damages caused by a defective firearm or ammunition, or to enforce a valid statute, rule, or ordinance, unless such an action is otherwise barred by the bill.
