This bill amends the existing Massachusetts law to provide further protection against child enticement. The key provisions are: (1) It prohibits any person, without the permission of the child's parent or guardian, from knowingly enticing a child under 16 years old to enter a vehicle, unless the person is a law enforcement officer, emergency services provider, firefighter, or other authorized individual acting within the scope of their duties. (2) It establishes an affirmative defense if the person acted in response to a bona fide emergency or to preserve the child's health, safety, or welfare. (3) Violations of this law can result in imprisonment of up to 5 years in state prison or 2.5 years in county jail, and/or a fine of up to $5,000.
