This bill amends the Education Code to change the requirements for determining resident status of students at public institutions of higher education in Texas. The key provisions are: (1) a person must have established and maintained a domicile in Texas for at least one year before the academic term to be considered a Texas resident, and (2) a person who is not authorized to be present in the United States may not be considered a Texas resident. The bill also allows public institutions to reclassify students previously classified as Texas residents under the old law if they do not meet the new requirements. The bill takes effect on September 1, 2023.
