This bill establishes the offenses of "Reckless Endangerment of an Emergency Service Person in the Second Degree" and "Reckless Endangerment of an Emergency Service Person in the First Degree." The second-degree offense applies to situations where a person, without obtaining a required building permit, alters a building in a way that impedes emergency evacuation and results in the injury of an emergency responder. The first-degree offense applies when such conduct results in the death of an emergency responder or the person has a prior conviction for either degree of the offense. The terms "emergency service person" are defined to include firefighters, police officers, peace officers, emergency services professionals, code enforcement officers, fire inspection personnel, and building inspectors.
