This bill amends the Texas Business & Commerce Code to add a new subchapter, "Subchapter E. Sexual Material Harmful to Minors," which requires commercial entities that knowingly and intentionally publish or distribute more than one-third sexual material harmful to minors on an Internet website, including social media platforms, to use reasonable age verification methods to verify that individuals attempting to access the material are 18 years of age or older. The bill also prohibits the retention of any identifying information of the individual after access has been granted. The bill provides for civil liability for violations, but exempts bona fide news or public interest broadcasts, websites, reports, or events, as well as internet service providers, search engines, and cloud service providers that are not responsible for the creation of the content.
