This bill amends the environmental conservation law to require the Department of Environmental Conservation (DEC) to promulgate ambient air quality standards for certain toxic air contaminants, such as benzene, formaldehyde, and mercury, by December 31, 2025. The standards must be based on the best available scientific data on the potential adverse health effects of each contaminant. The bill also requires the DEC to incorporate these toxic air contaminants into permits for major sources (those that emit at least 10 tons per year of a single toxic air contaminant or 25 tons per year of a combination) starting January 1, 2026. Additionally, the DEC must establish regulations by December 31, 2025, for when and how fenceline monitoring of toxic air contaminants will be required for major sources, particularly those located near or within disadvantaged communities.
