This bill, the DETERRENT Act (Defending Education Transparency and Ending Rogue Regimes Engaging in Nefarious Transactions Act), amends the Higher Education Act of 1965 to: 1) Require additional disclosures from institutions of higher education on foreign gifts and contracts, including more detailed information on the foreign source, intended purpose, and contract terms. It also requires institutions to designate a compliance officer responsible for certifying the accuracy of these disclosures. 2) Prohibit institutions from entering into contracts with foreign countries of concern or foreign entities of concern, while allowing the Secretary of Education to issue waivers in certain cases. 3) Require institutions to maintain a policy and public database for their employees to disclose foreign gifts and contracts above certain monetary thresholds. 4) Require specified higher education institutions to file annual reports disclosing investments of concern, such as investments in foreign countries of concern or foreign entities of concern. The bill also establishes enforcement mechanisms, including the ability for the Secretary of Education to investigate violations and impose fines, as well as a single point-of-contact at the Department of Education to assist institutions with compliance.
