This bill mandates that all state, county, and municipal law enforcement agencies must submit every sexual assault forensic evidence kit, collected from a victim who has consented to its release, to the appropriate forensic laboratory for testing within 10 calendar days of the victim's medical forensic examination, following guidelines to be established by the Division of Criminal Justice. Additionally, medical facilities must notify law enforcement within 24 hours of collecting such a kit, and law enforcement must then take possession of the kit within three business days. The bill also requires that kits from victims who have not reported the crime or consented to release be retained for at least 20 years, or 20 years after the victim turns 18 if they are a minor, during which time the victim retains the right to report the crime and have the kit tested. The Attorney General is tasked with issuing necessary guidelines to implement these provisions.
