This bill mandates that every sexual assault forensic evidence kit collected from a victim who has consented to the release of the evidence to law enforcement must be submitted to the appropriate forensic laboratory for testing within specific timeframes. It also requires medical facilities conducting sexual assault medical forensic examinations to notify the appropriate law enforcement agency within 24 hours of collecting a new kit, and for law enforcement to take possession of the kit within three business days. Additionally, the bill requires the retention of kits collected from victims who have not reported the crime or consented to the release of evidence for a minimum of 20 years, or 20 years after a minor victim reaches the age of 18. The victim has the right to report the crime and submit the kit for testing at any time during the retention period.
