This bill mandates that all state, county, and municipal law enforcement agencies must submit every sexual assault forensic evidence kit, collected from a victim who has consented to its release, to the appropriate forensic laboratory for testing within 10 calendar days of the victim's medical examination, or as otherwise directed by guidelines from the Division of Criminal Justice. Medical facilities must notify law enforcement within 24 hours of collecting such a kit, and law enforcement must take possession within three business days. For kits collected from victims who have not reported the crime or consented to its release, these kits must be preserved for at least 20 years, or 20 years after the victim turns 18 if they are a minor, with the victim retaining the right to report and have the kit tested at any time within that period. The Attorney General is responsible for issuing any necessary guidelines to implement these provisions.
