Bill Summary

This bill would delay the implementation of the Department of Environmental Protection's (DEP's) Advanced Clean Trucks (ACT) regulations to January 1, 2027. Under current law, N.J.A.C. 7:27-31.3, the regulations would become operative on January 1, 2025. The DEP adopted the Advanced Clean Trucks regulations in 2021. Pursuant to P.L.2003, c.266 (C.26:2C-8.15 et al.), the DEP is authorized to implement California's Low Emission Vehicle Program in New Jersey. The ACT regulations would require, among other things, that manufacturers of medium-duty and heavy-duty motor vehicles sell an increasing percentage of zero-emissions vehicles, capping at 40 percent to 75 percent of annual sales in 2035, depending on the type of vehicle sold.
