This bill amends the New York education law to strengthen the Board of Regents' authority over charter schools by modifying the process for charter approval. Currently, when the Board of Regents returns a proposed charter to the charter entity with recommendations, the entity can resubmit the charter. The proposed changes eliminate the previous provision that would automatically approve a charter if not acted upon within 30 days, and instead give the Board of Regents final and more decisive approval power. Specifically, the bill requires that no resubmitted proposed charter can be approved unless all of the Board of Regents' recommendations are fully satisfied, and the Board of Regents can recommend that a charter be abandoned entirely. This effectively gives the Board of Regents ultimate control over whether a new or renewed charter school can move forward, increasing state-level oversight of the charter school authorization process. The bill would take effect 30 days after becoming law.
