This bill expands the circumstances under which the state of Colorado can distribute essential materials (such as personal protective equipment, ventilators, and other emergency supplies) from its stockpile. The bill broadens the definition of "essential materials" and allows their distribution not just during declared disaster emergencies, but also in other circumstances that could help protect public health or safety. The distribution can now be made to a wider range of entities, including schools, local public health agencies, hospitals, primary care providers, nonprofit organizations, faith-based organizations, tribal governments, and their community partners. Importantly, the bill allows for distribution of materials even in non-emergency times to prevent them from expiring unused, which is considered a way to protect public health. Starting in January 2027, the department will be required to provide an annual report during its SMART Act hearing, detailing each acquisition and distribution of essential materials, including dates, quantities, recipients, reasons, and costs. This legislation aims to create more flexibility in managing the state's emergency material stockpile and ensure these resources can be used effectively to support community preparedness and response.
