This bill allows certain law enforcement officers (LEOs) to receive retirement benefits while continuing to work in law enforcement roles. Specifically, the bill permits state and local law enforcement officers who are at least 59.5 years old to elect to receive retirement allowances without fully separating from service. Officers can also return to work after retirement, after a brief separation period (six months for state officers, one month for local officers), and continue receiving their retirement benefits. The bill includes several important provisions: officers cannot accrue additional membership service while receiving retirement benefits, employers will make both employer and employee contributions, and officers become ineligible for certain supplemental benefits like disability income. The special separation allowance for these officers will continue to be calculated based on their years of service and base compensation. The bill has a sunset provision, with these new provisions set to expire on December 31, 2029, and includes a $10 million appropriation to help cover the increased costs of implementing these changes. The legislation aims to provide more flexibility for experienced law enforcement officers to continue working while also receiving their earned retirement benefits.
