Whereas, acts and resolves of the Legislature do not become effective until 90 days after adjournment unless enacted as emergencies; and Whereas, there are currently intoxicating hemp products for sale in this State for which there is no legal restriction preventing sale to minor children; and Whereas, some of those products may be designed or packaged in a manner that a person, including a child, could potentially be led to confuse the intoxicating products for nonintoxicating products typically marketed to children, such as gummies or similar products; and Whereas, ingestion of intoxicating hemp products by a child can cause harm to the child; and Whereas, it is in the interest of child safety for the restrictions directed by this legislation to go into effect as soon as possible; and Whereas, in the judgment of the Legislature, these facts create an emergency within the meaning of the Constitution of Maine and require the following legislation as immediately necessary for the preservation of the public peace, health and safety; now, therefore,
AI Summary
This bill introduces comprehensive regulations for hemp-derived products with potential intoxicating effects, specifically targeting sales to individuals under 21 years old. The legislation defines several key categories of cannabinoids, distinguishing between "nonintoxicating cannabinoids" (like CBD and CBG) and "potentially intoxicating cannabinoids" (which include various forms of tetrahydrocannabinol and its derivatives). A "potentially intoxicating hemp product" is defined as an ingestible hemp-derived consumer product containing more than 0.3% potentially intoxicating cannabinoids and less than a 10:1 ratio of nonintoxicating to intoxicating cannabinoids. The bill prohibits selling such products to anyone under 21 and mandates that these products must be packaged in child-resistant and tamper-evident packaging, with labeling that does not cause consumer confusion or violate trademark laws. The bill is classified as an emergency measure, meaning it takes effect immediately upon approval, driven by concerns about child safety and the potential harm from unrestricted sales of intoxicating hemp products that might be attractively packaged or mistaken for child-friendly items like gummies.
