Bill Summary

This bill prohibits any funds of this state, any county, village, town, long-term care district, any subdivision of this state, or any subdivision or agency of any county, city, village, or town and any federal funds passing through the state treasury from being authorized for or paid to any person to subsidize, reimburse, or otherwise provide compensation for any health care services for an individual who is not lawfully present in the United States. The prohibitions described under the bill do not apply to the extent that a payment of funds described under the bill is required under federal law or to the extent that the application of the prohibitions described under the bill would result in the loss of any federal funds. For further information see the state and local fiscal estimate, which will be printed as an appendix to this bill.

AI Summary

This bill prohibits state, county, local, and federal funds passing through the state treasury from being used to pay for health care services for individuals who are not legally present in the United States. The legislation creates a new section in Wisconsin statutes (20.926) that broadly restricts funding for health services to undocumented immigrants. However, the bill includes two key exceptions: first, if federal law requires such funding to be provided, and second, if applying this restriction would result in the loss of federal funding. The term "not lawfully present" refers to individuals who are in the United States without legal authorization, such as those who entered the country without proper documentation or who have overstayed their visa. This bill aims to limit public spending on health services for undocumented individuals, potentially impacting access to medical care for this population while also protecting potential federal funding sources.
