Bill Summary

Under this bill, if the Department of Natural Resources finds that there has been an exceedance of groundwater standards or of any standard for perfluoroalkyl or polyfluoroalkyl substance (commonly known as PFAS) in a proposed or promulgated DNR rule, DNR must notify the county health department, tribal health department, and county land and conservation department in the affected county. DNR must also notify the county health department, tribal health department, and county land and conservation department in any adjacent county that DNR determines may be negatively affected by the exceedance. The bill requires DNR to provide these notices within seven business days after verifying that an exceedance has occurred. The bill also requires DNR to create and maintain a notification system for notifying county health departments, tribal health departments, and county land and conservation departments of the types of exceedances that trigger the notice requirement. For further information see the state fiscal estimate, which will be printed as an appendix to this bill. LRB-5324/1 ZDW:cdc&cjs 2025 - 2026 Legislature SENATE BILL 628

AI Summary

This bill requires the Wisconsin Department of Natural Resources (DNR) to establish a notification system for informing county and tribal health departments and county land and conservation departments when groundwater protection standards or standards for PFAS (per- and polyfluoroalkyl substances, which are human-made chemicals found in many consumer products) are exceeded. Specifically, when DNR verifies an exceedance, it must notify the health departments and conservation departments in both the directly affected county and any adjacent counties that may be negatively impacted. The notifications must be provided within seven business days of verifying the exceedance, and these notices will be subject to public inspection. The bill also allows DNR to establish procedures for how these notifications will be made. The bill will take effect on the first day of the seventh month after its publication, providing time for DNR to develop the required notification system. This legislation aims to improve transparency and communication about potential environmental and health risks related to groundwater contamination.
