Bill Summary

This bill prohibits health insurance policies and plans, including self-insured governmental plans, and the Medical Assistance program from knowingly covering a human organ transplant or posttransplant care if the transplant operation is performed in or the human organ to be transplanted was procured by sale or donation originating in the People’s Republic of China or in another country, as designated by the Department of Health Services, known to have participated in forced organ harvesting. However, the bill does not prohibit any posttransplant service or care provided to save the life of an individual after the individual receives a human organ transplant that is prohibited under the bill. The bill defines “forced organ harvesting” as the removal of one or more organs from a living person, by means of coercion, abduction, deception, fraud, or abuse of power over a position of vulnerability, or from a person killed for the purpose of removal of one or more organs. Under the bill, DHS may designate a country whose government funds, LRB-5142/2 JPC&SWB:cjs&skw 2025 - 2026 Legislature SENATE BILL 672 sponsors, or otherwise facilitates forced organ harvesting to be included in the prohibition. The Medical Assistance program is a joint federal and state program that provides health services to individuals who have limited financial resources. For further information see the state fiscal estimate, which will be printed as an appendix to this bill.

AI Summary

This bill prohibits health insurance policies, self-insured health plans, and the Medical Assistance program from knowingly covering human organ transplants or post-transplant care if the transplant is performed in, or the organ originates from, the People's Republic of China or other countries designated by the Department of Health Services as participating in forced organ harvesting. Forced organ harvesting is defined as the removal of organs from a living person through coercion, abduction, deception, fraud, or abuse of power, or from a person killed specifically for organ removal. The Department of Health Services may designate countries that fund, sponsor, or facilitate forced organ harvesting. Importantly, the bill does not prohibit post-transplant services necessary to save a patient's life after receiving a transplant that would otherwise be prohibited. The bill will take effect on the first day of the fourth month after its publication and will initially apply to insurance policies and plans in their next policy or plan year, with special considerations for policies governed by collective bargaining agreements.
