This bill, known as the "Garden State Balcony Solar Act," aims to make it easier for New Jersey residents to use portable solar generation devices, which are moveable solar power systems with a maximum output of 1,200 watts designed to plug into a standard 120-volt outlet and offset electricity consumption. The act exempts these devices from needing interconnection agreements or participating in net metering programs with electric public utilities, and utilities cannot charge fees or require additional equipment beyond what's integrated into the device. While utilities are protected from liability for damages or power issues caused by these devices, the devices themselves must be certified by a nationally recognized testing laboratory and include a feature to prevent exporting power during an outage. The bill also clarifies that these devices must comply with electrical codes, with some exceptions for smaller devices (400 watts or less) that would otherwise require building alterations, and sets a combined 1,200-watt limit per service address unless an interconnection agreement is obtained. Furthermore, landlords and other governing entities like homeowners' associations cannot prohibit tenants or unit owners from using these devices on their leased premises or units, including balconies and patios, though reasonable restrictions on placement and dimensions are allowed, and tenants are responsible for any damages. Tenants must provide 14 days' notice before installing a device, and municipalities are prohibited from banning their use or requiring permits for them, though building and electrical code compliance for any modifications remains necessary.
